Everything You Always Wanted to Know About the Affordable Care Act as a Government Contractor

The Affordable Care Act (ACA) imposes significant compliance and cost challenges for employers generally, but especially those for those employers contracting with the federal government.  This 90-minute webinar will focus on the unique challenges facing government contractors in complying with various aspects of the health reform law, including what is commonly referred to as the Act’s employer mandate or “pay or play” provisions.  The webinar will also discuss strategies that may be available to contractors to assist them in complying with the new rules, as well as controlling costs, including those costs arising under a respective contract or otherwise.

Learning Objectives

  • Learn how the employer “pay or play” provisions will apply to contractors generally.
  • Discover whether satisfaction with the SCA and/or DBA in providing the requisite fringe benefit rate will be deemed to constitute “playing” for purposes of the ACA such that the contractor incurs no penalty.
  • Understand whether an employer that chooses to “pay” versus “play” can charge back the assessable payment it incurs to the government.
  • Determine whether providing “choice” to an employee in its use of fringe benefit dollars could increase the likelihood that the employer is subject to penalty under “pay or play”.
  • Understand the new rules around wellness program incentives and how the structure of such can negatively affect a contractor’s compliance with “pay or play”.
  • Learn how the new provisions of the ACA put increased pressure on worker classification issues (including employee vs. independent contractor and employee vs. leased employee) and the potential liabilities that can accrue to contractors if they fail to classify their workers correctly.
  • Recognize how contractors that rely on favorable state law rules to access affordable large group insurance coverage may be at risk of losing access to such coverage because of the ACA’s preemption of such state law rules.
  • Discover new tax reporting and employee notice obligations that will apply to contractors because of the ACA.
  • Receive an overview of audit risks and appeal rights for contractors with respect to “pay or play.”
  • Become familiar with strategies available to contractors to facilitate compliance with the ACA’s “pay or play” provisions as well as control any unallowable costs.
  • And much more!
