Overview

Failure to understand and comply with the McNamara-O’Hara Service Contract Act (SCA), or Service Contract Labor Standards (SCLS) can lead to costly outcomes, withholding of contract funds, and even debarment. Cross-functional (i.e., Human Resources, Contracts, Payroll, Accounting) understanding of the SCA is imperative to successfully administer an SCA contract. Many contractors find SCA confusing and intimidating, which often leads them to avoid SCA contracts entirely. While this may have once been a good strategy, it is increasingly more difficult to escape contracts covered by FAR 52.222-41 Service Contract Labor Standards as the application of the SCA becomes more frequent. In fact, retroactive coverage enforced by the U.S. Department of Labor has also become more common.

In this seminar, we will discuss SCA applicability, requirements, and best practices for compliance. This training will provide valuable insight and practical strategies to effectively and compliantly manage SCA contracts.

Learning Objectives

At the completion of this one-day comprehensive course, participants will be able to:

  • Identify the types of contracts which are or should be covered by FAR 52.222-41 Service Contract Labor Standards
  • Understand which employees are impacted by the requirements of SCA
  • Utilize a Wage Determination and identify the required minimum wage, health and welfare, vacation, holiday, sick leave, etc.
  • Understand when a Collective Bargaining Agreement is incorporated as the Wage Determination and the subsequent impact on contract administration

  • Option year modifications and price adjustments under FAR 52.222-43 Fair Labor Standards Act and Service Contract Labor Standards-Price Adjustment (Multiple Year and Option Contracts) and FAR 52.222-44 Fair Labor Standards Act and Service Contract Labor Standards-Price Adjustment
  • Successful contract transition
  • Notices and appropriate communications
  • Recordkeeping requirements
  • Components of and suggestions for self-audits and subcontractor accountability
  • Overview of the audit process related to SCA by the Department of Labor Wage and Hour division
