The Pros and Cons of Bid Protests: "Corrective Action" and Other Strategies for Success

Most government contractors know that the U.S. Government Accountability Office (“GAO”) sustains less than 20 percent of bid protests. If most protests are unsuccessful, why should you consider investing the time and considerable expense of filing a GAO protest, or intervening in a pending protest?

One reason that’s often overlooked is the protest that results in agency “corrective action.” Although an agency’s decision to take corrective action isn’t published anywhere, it occurs more often than GAO’s sustaining of a protest. This 90-minute webinar will discuss this and other strategies of bid protests, both for the protesting company and for the “intervener” company whose contract award is being protested. Speaker and Presenter Information

Jeffrey Weinstein is the founder of The Weinstein Law Group, a Washington, D.C. law firm that helps companies around the world sell their products and services to the United States and state governments. Mr. Weinstein has provided legal and strategic advice to a wide variety of companies throughout the world for over 25 years in all areas of federal and state procurement contract formation, administration, audit, and litigation. He has filed and defended bid protests before the U.S. Government Accountability Office and state contract appeal boards. In addition, he represents clients in federal and state courts and in administrative negotiations, and has lobbied elected officials and staff in the U.S. Congress. Mr. Weinstein has lectured on federal procurement issues before the National Contract Management Association, the American Bar Association, state bar associations, and other organizations. Before starting his own firm in 2001, he headed the Government Contracts practice group at Eckert Seamans Cherin & Mellot.
