Intellectual Property Rules in Government Contracts: Know Your Technical Data and Patent Rights

Doing business with the U.S. Government brings with it an abundance of unique rules and regulations governing the allocation of rights to intellectual property. These rules and regulations are designed to balance the contractor’s contribution in developing the intellectual property with the U.S. Government’s investment in it, as well as other policy considerations. For contractors, it is imperative to understand and to manage adherence to these rules to properly and effectively protect their intellectual property.

This 90-minute webinar will provide an overview of the key principles governing the allocation of rights in technical data, computer software, and patents. The speakers will also discuss changes to the treatment of commercial items, statutory changes in National Defense Authorization Act for FY 2012 (NDAA 2012) affecting defense contractors as well as regulations relating to patent rights in FAR Part 27 and DFARS Part 227, and contract clauses in FAR 52.227 and DFARS 252.227. With this background, the webinar will also provide some practical pointers to help contractors avoid traps for the unwary that could lead to the compromise of their intellectual property.

Speaker and Presenter Information

John E. McCarthy, Jr. is a partner in Crowell & Moring LLP�s Government Contracts Group. John focuses on a wide range of government procurement law, with a particular emphasis on technology-related issues. John has litigated and provided counseling on issues including patent and data rights, bid protests and other contract formation issues, contract claims, prime/sub disputes, socioeconomic issues, and false claim matters. John is a Vice-Chair of the American Bar Association�s Public Contract Law Section, Intellectual Property Committee, and has written and spoken extensively on government contracts technology issues and intellectual property rights. John has a master�s degree in electrical engineering, and prior to joining Crowell & Moring LLP, worked for ten years designing and developing computer and communication systems for various government contractors. Jonathan M. Baker is an associate in Crowell & Moring LLP�s Government Contracts Group. Jon�s practice focuses on a wide range of government procurement law, including litigation, bid protests before the Government Accountability Office and U.S. Court of Federal Claims, patent and data rights, Public Law 85-804 indemnification claims, contract terminations, and investigations of potential civil and criminal matters. Prior to attending law school, Jon earned his bachelor�s degree in engineering, double-majoring in biomedical and electrical engineering, and served for six years as an active duty officer in the U.S. Air Force.
