Requesting Fitness-for-Duty Exams in the Federal Workplace: What's Allowed, What's Not
Make the right call regarding fitness-for-duty exams!
Concerns that an employee is unfit for a job raise numerous questions … When can the agency request a fitness-for-duty exam? Are the rules different for physical and psychiatric evaluations? What if the employee has a disability?
Spend 90 minutes learning the answers to these questions and much more directly from Marilyn Mattingly, renowned expert on federal medical and leave issues. Even better, Q&A breaks during the session mean you can get Ms. Mattingly’s direct answers to your questions.
In straightforward language, Ms. Mattingly will explain the rules for offering/ordering fitness-for-duty exams, the criteria that must be met for doing so and the case law outlining the criteria – empowering you to make the right call on whether or not to order exams and to cite the correct rules and/or case law to support your decisions.
And, to ensure a full education on the topic you’ll learn:
- The employee’s responsibilities in complying with exam orders
- Medical documentation that may be obtained
- Who is responsible for paying for the examination
- The role of direct threat
Plus, you’ll get guidance on handling specific situations such as when the employee’s behavior is cause for removal; when the agency needs to determine if the employee can be medically accommodated in a vacant, funded position; and how to avoid violations of the Rehabilitation Act.
