A US Contractor's Guide to Doing Business in Canada



Join Borden Ladner Gervais LLP of Canada and Steptoe & Johnson LLP of Washington DC for a 90 minute webcast geared to US companies wishing to perform work for Canadian public sector customers, particularly in the aerospace, defense, engineering and government services areas. 

The program will include: 
  • A brief overview of Canadian business culture and the government procurement market. 
  • Basics of Canadian government procurement rules and regulations, with emphasis on aerospace, defense, and engineering/construction procurement. 
  • Any key requirements for US (and foreign) companies wishing to sell directly to the Canadian government. 
  • A brief summary of offset, import and taxation issues relevant to selling to the Canadian government as a foreign company. 
  • A brief summary of Canadian ethics, debarment and anti-corruption laws relevant to public sector sales, as well as a discussion of US legal considerations applicable to American companies working in or with Canadian and US government procurement rules impacting government to government sales. 
  • A brief summary of export control considerations applicable to working with the Canadian government and Canadian companies.

Andrew D. Irwin, Partner
Steptoe & Johnson LLP

Andrew D. Irwin is a partner in Steptoe’s Washington office. He focuses his practice at the intersection of international regulatory law and government procurement, concentrating primarily on corporate investigations and related compliance counseling.  He has a particular background in laws and regulations that relate to export controls/sanctions, foreign corruption, and government contracting fraud.  He also has considerable experience in general corporate ethics/compliance counseling, as well as ethics/compliance program administration and development. He has conducted investigations and reviews in Europe, Asia, Africa, and the Middle East (including on the ground in wartime Iraq).  Prior to coming to Steptoe, Mr. Irwin spent several years as inside counsel for one of the world’s largest engineering and construction companies.
 
Mr. Irwin has been an Associate Professorial Lecturer in Law at the George Washington University Law School, a guest lecturer for its Government Contracts Program, and has given numerous CLE presentations on a wide range of international and government contracts topics for Federal Publications Seminars. His CLE presentations have included developing and teaching a course on ITAR compliance and voluntary disclosures as well as a course on the fundamentals of government contracts.  He also has developed, and co-teaches, Federal Publications’ live course regarding the FCPA.  He is also a frequent author on government contracts, international regulatory matters such as export controls/FCPA, and corporate compliance.  In 2011 he hosted, with Lucinda Low, a multi-part series of video tutorials for Thomson Reuters on global corruption issues and coordinated the firm's production of a series of videos on export control reform for Thomson Reuters in 2014.

Gerry Stobo, Partner
Borden Ladner Gervais LLP ("BLG")

Gerry Stobo focuses his practice on public procurement law and government contracting, trade law, and public law. He acts for government and private sector clients on complex public procurement law matters involving design of procurement processes, drafting procurement documents, advising on terms and conditions of procurements, and assisting with legal challenges to procurements. Gerry also acts for clients on complex trade cases involving dumping and subsidy claims. In these matters, he has represented Canada’s trade remedy agency – the Canadian International Trade Tribunal – and private sector corporations. Additionally, Gerry has been lead counsel for scientific panels in two environmental reviews of chemical products.

Prior rior to joining BLG, Gerry was General Counsel at the Canadian International Trade Tribunal from 1995 to 2001, and at the Immigration and Refugee Board from 1989 to1994. He has appeared before all levels of trial and appeal courts and tribunals, including Supreme Court of Canada and the Security Intelligence Review Committee.
